These Terms & Conditions govern all bookings, reservations, stays, payments, cancellations, and use of apartments operated, marketed, or managed by Title Apartments.
By completing a booking, making payment, checking in, or occupying any Title Apartments property, you confirm that you have read, understood, and agreed to these Terms.
This draft should be reviewed by a Maryland attorney before publication, especially because Montgomery County short-term rental rules, licensing, taxes, condominium rules, and consumer protection requirements may apply. Montgomery County imposes a 7% Room Rental and Transient Tax on qualifying short stays, and Maryland consumer complaints may be handled through the Maryland Attorney General’s Consumer Protection Division.
1. Definitions
In these Terms:
“Title Apartments,” “we,” “us,” or “our” means Title Apartments, located at 4710 Elm Street, Bethesda, MD 20814.
“Guest,” “you,” or “your” means the person making the booking and all persons staying in or visiting the apartment.
“Apartment” or “Property” means any furnished apartment, serviced apartment, holiday apartment, or short-term accommodation provided by Title Apartments.
“Booking” or “Reservation” means any confirmed accommodation reservation made directly through our website, by email, by phone, or through a third-party booking platform.
“OTA” means an online travel agency or booking platform, including Airbnb, Booking.com, Expedia, Vrbo, Agoda, Hotels.com, or similar platforms.
“Check-In Date” and “Check-Out Date” mean the arrival and departure dates stated in the booking confirmation.
2. Booking Acceptance
A booking is only confirmed once:
- Title Apartments issues written confirmation; and
- The required payment has been received and approved.
We reserve the right to refuse, cancel, or decline any booking where:
- Payment has not been received;
- Information provided is false or incomplete;
- Fraud is suspected;
- The guest breaches these Terms;
- The booking violates building, HOA, condominium, city, county, state, or federal rules.
3. Guest Eligibility
Guests must be at least 18 years old to make a booking.
By booking, you confirm that:
- You are legally able to enter into a binding agreement;
- You are responsible for all guests and visitors in your party;
- You will use the apartment only for lawful short-term residential accommodation;
- You will not sublet, resell, assign, or transfer the booking without our written consent.
4. Rates, Payments, and Taxes
All prices are displayed in U.S. dollars (USD) unless stated otherwise.
The total booking amount may include:
- Accommodation charges;
- Cleaning fees;
- Service fees;
- Security deposit;
- Applicable taxes;
- Additional guest fees;
- Parking fees, where applicable;
- Other charges disclosed at the time of booking.
For stays subject to Montgomery County lodging rules, applicable taxes may include the Montgomery County Room Rental and Transient Tax, currently listed by the county as 7% of the total room rental collected.
Full payment may be required at the time of booking unless otherwise agreed in writing.
5. Security Deposit
Title Apartments may require a refundable security deposit before check-in.
The deposit may be used to cover:
- Property damage;
- Missing items;
- Lost keys, fobs, or access cards;
- Excessive cleaning;
- Smoking or vaping violations;
- Unauthorized pets;
- Unauthorized parties or events;
- Overstay charges;
- Violation of house rules.
If deductions are made, Title Apartments will provide a written explanation. The security deposit does not limit the guest’s liability. If damage or additional costs exceed the deposit, the guest remains responsible for the full amount.
6. Cancellation Policy
Cancellation terms depend on the rate selected and the booking channel used.
6.1 Non-Refundable Bookings
Bookings marked as non-refundable, discounted, promotional, or special offer are not refundable after confirmation.
If a guest cancels, fails to arrive, checks out early, or is unable to travel for any reason, Title Apartments may retain 100% of the booking amount.
6.2 Flexible Bookings
Unless the booking confirmation states otherwise:
- Cancellation 14 or more days before check-in: full refund;
- Cancellation 7–13 days before check-in: 50% refund;
- Cancellation less than 7 days before check-in: non-refundable.
6.3 Peak Periods and Special Events
During peak travel periods, holidays, major events, conferences, government events, graduations, medical conferences, or high-demand dates in the Washington, D.C. metropolitan area, stricter cancellation terms may apply.
Where such terms apply, they will be stated at the time of booking.
6.4 No-Show
A no-show occurs when a guest does not arrive on the check-in date and does not notify Title Apartments in writing.
No-shows are non-refundable.
7. Booking Amendments
Any request to change dates, guest numbers, apartment type, or booking details must be submitted in writing to:
Changes are subject to:
- Availability;
- Rate differences;
- Administrative fees;
- Building or licensing restrictions;
- Approval by Title Apartments.
Title Apartments is not required to approve any amendment after a booking has been confirmed.
8. Check-In and Check-Out
Standard check-in: from 3:00 PM
Standard check-out: by 10:00 AM
Early check-in and late check-out are not guaranteed and must be approved in writing.
Late check-out without approval may result in additional charges.
Guests must return all keys, fobs, access cards, parking passes, and other access devices at check-out.
9. Access Devices
Guests are responsible for all keys, fobs, access cards, parking passes, smart lock codes, and entry devices issued to them.
Lost or damaged access devices may result in replacement charges, including locksmith fees, reprogramming fees, building access fees, or security charges.
Guests must not share access codes or keys with unauthorized persons.
10. Apartment Allocation and Reallocation
Title Apartments may reallocate guests to an alternative apartment before or during a stay where necessary due to:
- Maintenance;
- Safety concerns;
- Building restrictions;
- Emergency repairs;
- Owner withdrawal;
- Utility failure;
- Force majeure;
- Operational necessity.
Where possible, the replacement apartment will be of a similar or higher standard.
Reallocation to a comparable apartment does not automatically entitle the guest to a refund, discount, or cancellation without penalty.
11. Occupancy Limits
Only registered guests listed in the booking may occupy the apartment.
The maximum occupancy stated in the booking confirmation must not be exceeded.
Unauthorized overnight guests, parties, events, or gatherings are strictly prohibited.
Violation of this rule may result in:
- Immediate termination of the stay;
- Removal from the property;
- Loss of deposit;
- Additional charges;
- No refund for unused nights.
12. Guest Conduct and House Rules
Guests must:
- Respect neighbors and building residents;
- Follow all building, HOA, condominium, and community rules;
- Keep noise to a reasonable level;
- Observe quiet hours between 10:00 PM and 7:00 AM;
- Use the apartment only for lawful accommodation purposes;
- Keep the apartment clean and in good condition;
- Report maintenance issues promptly;
- Avoid blocking hallways, entrances, elevators, or emergency exits.
Guests must not:
- Host parties or events;
- Smoke or vape inside the apartment;
- Use illegal drugs;
- Engage in illegal activity;
- Disturb neighbors;
- Damage the property;
- Tamper with smoke detectors, fire alarms, cameras, locks, WiFi equipment, or safety systems;
- Move furniture without permission;
- Use the apartment for commercial filming, photo shoots, or paid events without written approval.
13. No Smoking Policy
All Title Apartments properties are strictly non-smoking.
Smoking, vaping, marijuana, cannabis products, hookah, or similar substances are not permitted inside apartments, balconies, hallways, elevators, common areas, or any prohibited building area.
Violation may result in:
- Deep cleaning charges;
- Odor removal charges;
- Damage charges;
- Loss of security deposit;
- Immediate termination of stay without refund.
14. Pets Policy
Pets are not permitted unless approved in writing before check-in.
Where pets are approved, additional fees, deposits, or cleaning charges may apply.
Service animals will be handled in accordance with applicable federal, state, and local laws.
Guests are responsible for any damage, noise, cleaning, or injury caused by animals brought onto the property.
15. Property Damage
Guests are responsible for any damage caused by themselves, their visitors, children, pets, or unauthorized occupants.
Damage may include:
- Broken furniture;
- Damaged appliances;
- Stained carpets or upholstery;
- Missing towels, linens, electronics, or kitchenware;
- Wall damage;
- Smoking damage;
- Plumbing blockages caused by misuse;
- Excessive cleaning needs.
Title Apartments may charge the card on file or invoice the guest for the full cost of repair, replacement, cleaning, or loss.
16. Cleaning and Condition of Apartment
The apartment will be professionally cleaned before check-in.
Guests must report any pre-existing damage, cleanliness issue, or missing item within 2 hours of check-in.
Failure to report issues within this period may result in the apartment being treated as accepted in good condition.
Guests are expected to leave the apartment in reasonable condition upon departure.
17. Amenities and Building Facilities
Amenities may include, depending on the apartment or building:
- High-speed WiFi;
- Smart TV;
- Fully equipped kitchen;
- Washer and dryer;
- Gym or fitness center;
- Rooftop terrace;
- Pool;
- Parking;
- Elevator;
- Secure building access;
- Workspace;
- Concierge or front desk services.
Availability of building amenities may be affected by:
- Maintenance;
- Weather;
- Management rules;
- HOA or condominium restrictions;
- Safety issues;
- Seasonal closures;
- Third-party service interruptions.
Title Apartments does not guarantee uninterrupted access to shared amenities controlled by building management, condominium associations, or third-party providers.
18. Internet, Utilities, and Service Interruptions
Title Apartments aims to provide reliable utilities and internet access; however, we do not guarantee uninterrupted service.
We are not liable for interruptions caused by:
- Internet service providers;
- Power outages;
- Water outages;
- Building maintenance;
- Government works;
- Weather events;
- Utility company failure;
- Emergency repairs;
- Third-party technical issues.
No refund will be provided for temporary utility, WiFi, cable, elevator, pool, gym, or amenity interruptions unless required by applicable law.
19. Parking
Parking may be available only where stated in the booking confirmation.
Guests use parking facilities at their own risk.
Title Apartments is not responsible for:
- Theft from vehicles;
- Damage to vehicles;
- Parking tickets;
- Towing;
- Lost parking passes;
- Garage closures;
- Building parking restrictions.
Guests must follow all posted parking rules.
20. Personal Belongings and Valuables
Guests are responsible for securing their personal belongings.
Title Apartments is not responsible for loss, theft, or damage to personal property unless caused by our proven gross negligence or willful misconduct.
Guests are encouraged to obtain travel insurance covering valuables, electronics, luggage, medical items, documents, and personal belongings.
Lost items left after check-out may be stored for up to 30 days where reasonably possible. Unclaimed items may be donated, discarded, or disposed of.
21. Health, Safety, and Emergencies
Guests must follow all safety instructions, emergency procedures, fire alarms, evacuation notices, and building rules.
Guests must not disable or tamper with:
- Smoke detectors;
- Carbon monoxide detectors;
- Fire extinguishers;
- Sprinklers;
- Door locks;
- Security systems;
- Emergency exits.
In case of emergency, guests should call 911.
For non-emergency property issues, guests should contact Title Apartments using the contact details provided in the booking confirmation.
22. Third-Party Booking Platforms
If a booking is made through an OTA, the guest may also be subject to that platform’s terms and policies.
However, these Terms apply to the guest’s stay, conduct, property use, damage obligations, check-in, check-out, and house rules.
Where an OTA collects payment, cancellation or refund processing may be handled by that OTA.
Title Apartments is not responsible for:
- OTA website errors;
- Incorrect OTA descriptions;
- OTA payment delays;
- OTA refund decisions;
- OTA customer service representations;
- Platform service fees.
Guests should review all OTA terms before booking.
23. Chargebacks and Payment Disputes
Guests agree not to initiate improper chargebacks or payment reversals for valid charges, including confirmed bookings, cancellation penalties, damage charges, cleaning fees, or no-show charges.
Title Apartments reserves the right to dispute chargebacks using:
- Booking confirmations;
- Payment records;
- Guest communications;
- Check-in records;
- House rules;
- Damage reports;
- Photos or inspection records.
Guests may be liable for reasonable administrative, bank, or collection costs arising from improper disputes.
24. Early Departure
No refund is provided for early departure unless expressly agreed in writing or required by law.
This includes early departure due to:
- Change of travel plans;
- Illness;
- Family emergency;
- Weather;
- Flight cancellation;
- Personal preference;
- Dissatisfaction not reported during the stay;
- Failure to follow house rules.
Guests are strongly encouraged to purchase travel insurance.
25. Right to Refuse Check-In or Terminate Stay
Title Apartments may refuse check-in or terminate a stay if:
- Payment is incomplete;
- Identification cannot be verified;
- The guest provides false information;
- Occupancy limits are exceeded;
- The guest is disruptive, abusive, threatening, or intoxicated;
- The booking appears fraudulent;
- The guest violates house rules;
- Illegal activity is suspected;
- The property or neighbors are at risk;
- Building management, security, HOA, or law enforcement requires removal.
Where a stay is terminated due to guest misconduct or breach of these Terms, no refund will be provided.
26. Failure to Vacate
Guests must vacate by the agreed check-out time.
Failure to vacate may result in:
- Hourly late check-out fees;
- Additional nightly charges;
- Removal of personal items where legally permitted;
- Locksmith or security charges;
- Liability for losses caused to Title Apartments or incoming guests.
Overstaying does not create a tenancy, lease, or right of continued occupancy.
27. No Tenancy Created
Bookings with Title Apartments are for temporary accommodation only.
Nothing in these Terms creates:
- A lease;
- A landlord-tenant relationship;
- A permanent right of occupation;
- A right to renew;
- A right to remain beyond the confirmed booking period.
Guests are licensees for the limited purpose of short-term accommodation.
28. Compliance with Local Rules
Guests must comply with all applicable laws, including federal, Maryland, Montgomery County, Bethesda-area, building, condominium, HOA, and community rules.
Short-term rental regulations may vary depending on property type, length of stay, licensing, and building rules. Montgomery County materials indicate that short-term rental licensing and zoning requirements may apply to certain rentals.
Title Apartments reserves the right to cancel or modify bookings where required to comply with law, licensing, zoning, HOA, condominium, or building requirements.
29. Privacy and Personal Information
Title Apartments may collect personal information including:
- Name;
- Address;
- Email;
- Phone number;
- Payment details;
- Identification documents;
- Booking details;
- Guest communications;
- Stay preferences;
- Security or access records where applicable.
This information may be used to:
- Process bookings;
- Verify identity;
- Manage stays;
- Process payments;
- Comply with law;
- Protect property and guests;
- Communicate with guests;
- Improve services.
Title Apartments does not sell guest personal information.
Personal information may be shared with service providers where necessary, including payment processors, booking platforms, cleaning teams, building management, legal advisors, insurers, or law enforcement where legally required.
30. Accessibility
Guests requiring accessibility accommodations should contact Title Apartments before booking to confirm whether a specific apartment meets their needs.
Title Apartments will make reasonable efforts to provide accurate information about accessibility features but does not guarantee that every apartment or building is suitable for every accessibility requirement.
31. Medical and Institutional Disclaimer
Title Apartments may be located near medical, government, university, or business institutions including NIH, Walter Reed, or Washington, D.C. offices.
Unless expressly stated in writing, Title Apartments is not affiliated with, endorsed by, or officially connected to any hospital, university, government agency, embassy, or medical institution.
32. Force Majeure
Title Apartments is not liable for failure or delay caused by events beyond our reasonable control, including:
- Severe weather;
- Fire;
- Flood;
- Power outage;
- Utility failure;
- Pandemic;
- Government action;
- Civil unrest;
- War;
- Terrorism;
- Labor strike;
- Building emergency;
- Natural disaster;
- Law enforcement activity;
- Internet or utility provider failure;
- HOA, condominium, or building management restrictions.
Where a force majeure event makes the apartment unavailable, Title Apartments may cancel the booking and provide a refund for unused nights paid directly to Title Apartments, unless a different lawful policy applies.
33. Limitation of Liability
To the maximum extent permitted by law, Title Apartments is not liable for:
- Indirect or consequential losses;
- Lost profits;
- Lost business opportunities;
- Travel costs;
- Alternative accommodation costs;
- Emotional distress;
- Loss of enjoyment;
- Personal property loss;
- Third-party service failures;
- Building amenity closures;
- Utility interruptions.
Title Apartments’ total liability for any booking shall not exceed the amount paid directly to Title Apartments for that booking, except where liability cannot lawfully be limited.
Nothing in these Terms limits liability for fraud, intentional misconduct, or any liability that cannot be excluded under applicable law.
34. Complaints and Guest Support
Guests must report problems during their stay as soon as reasonably possible so Title Apartments has an opportunity to resolve them.

Complaints raised only after check-out may not qualify for compensation where the guest did not provide Title Apartments a reasonable opportunity to fix the issue during the stay.
Maryland consumers may also contact the Maryland Attorney General’s Consumer Protection Division, which provides mediation assistance for consumer disputes involving Maryland transactions.
35. Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Maryland and applicable federal laws of the United States.
Any dispute arising from these Terms, a booking, payment, cancellation, or stay shall be handled in the appropriate courts located in Montgomery County, Maryland, unless another venue is required by applicable law.
Before filing a legal claim, both parties agree to attempt good-faith resolution through direct communication.
36. Amendments to These Terms
Title Apartments may update these Terms at any time.
The version in effect at the time of booking will apply to that booking.
Updated Terms will apply to bookings made after publication on the Title Apartments website.
37. Entire Agreement
These Terms, together with the booking confirmation, invoice, house rules, and any written guest instructions issued by Title Apartments, form the entire agreement between the guest and Title Apartments.
If any clause is found invalid or unenforceable, the remaining clauses will remain in effect.
